7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PUBLICLYTRADEDCRYPTO.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES
- LOSS OF DATA, GOODWILL, OR REPUTATION
- INVESTMENT LOSSES OR FINANCIAL DAMAGES
- COST OF SUBSTITUTE GOODS OR SERVICES
- BUSINESS INTERRUPTION OR SERVICE DOWNTIME
WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.3 Maximum Liability Cap
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

YOU ACKNOWLEDGE THAT INVESTING IN SECURITIES, STOCKS, CRYPTOCURRENCIES, AND OTHER FINANCIAL INSTRUMENTS INVOLVES SUBSTANTIAL RISK, INCLUDING THE TOTAL LOSS OF INVESTED CAPITAL. WE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY INVESTMENT DECISIONS YOU MAKE OR FINANCIAL LOSSES YOU INCUR.
7.5 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless PubliclyTradedCrypto.com, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising from or related to:

- Your violation of any third-party rights, including intellectual property rights
- Any content or information you submit, post, or transmit through the Platform
- Your negligence, willful misconduct, or fraudulent activities
- Any investment decisions or financial losses resulting from your use of the Platform
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us in asserting any available defenses.
9. Termination and Suspension

9.2 Effect of Termination

These Terms, together with our Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and PubliclyTradedCrypto.com regarding the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
15. Assignment
You may not assign, transfer, or sublicense your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder to any third party without restriction or notice.
16. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, pandemics, internet outages, or technical failures.
17. U.S. Government Rights
If you are a U.S. Government entity, the Platform constitutes "Commercial Computer Software" and "Commercial Computer Software Documentation" as defined in Federal Acquisition Regulation (FAR) 12.212 and Defense Federal Acquisition Regulation Supplement (DFARS) 227.7202. Use, reproduction, and disclosure are subject to the restrictions set forth in these Terms.
18. Export Compliance
The Platform may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC). You represent that you are not located in, or a national of, any country subject to U.S. embargo or on any U.S. government list of prohibited or restricted parties.
